The way to incorporate a company in Mexico

Mexico is undoubtedly a magnet for entrepreneurs and international investors seeking to take advantage of a favorable environment for establishing businesses and attracting foreign direct investment due to: numerous free trade agreements, including the Mexico-United States-Canada Agreement (T-MEC); a young population and diverse workforce that includes a wide range of skills and specializations; government support for foreign investors; and a privileged geographical location that makes it a point of entry and exit for trade in Latin America and the world. Its proximity to North and South American markets places it in a strategic position for trade and business expansion.
It is important for any entrepreneur looking to expand his or her business and/or establish a company in Mexico to know the key steps to start operations. The first is to have a business plan, identify the target audience, the strengths of the product or service, research market costs and, once you have a solid vision, it will be time to get into the legal and bureaucratic aspects. The second is the choice of a name or corporate name to register the company, for this, it is advisable to have previously several options and request to the Ministry of Economy the authorization of its use.
After this, the by-laws must be drafted and presented before a notary or notary public and thus begin the incorporation of the corporation, defining the corporate purpose of the company, which must be lawful, viable and concrete, aligned with the business plan, defining the management scheme and the positions that will make the decisions.
After obtaining the articles of incorporation, a series of essential procedures are initiated that give legal form to the new business entity and allow its smooth operation in the economic environment, such as registration in the Federal Taxpayers Registry (RFC), which acts as a unique and mandatory tax identification for the legal entity, involves the presentation of the articles of incorporation and the completion of specific procedures before the tax authorities of the Tax Administration Service (SAT) and other governmental institutions.
The next vital step is the registration in the Public Registry of Property and Commerce, which confers to the company a legal existence in terms of property and commerce. It not only ensures the protection of property rights and facilitates the transfer of real estate or assets, but also gives the company greater credibility in the marketplace.
Once this process is completed, the company positions itself solidly in the commercial and legal arena, which is critical to its operations and reputation. In addition to their impact on the legality and credibility of the company, these steps also have significant implications for access to financial services. Having the RFC and registration with the Public Registry of Property and Commerce is often a requirement for opening corporate bank accounts.
Now then, every company requires personnel, so, in case of hiring workers, both the company and its workers must be registered before the Mexican Social Security Institute (IMSS), without forgetting that, in case the company requires foreign talent, either for training or the occupation of a position, it is important to have the Employer Registration Certificate before the National Institute of Migration, to issue the corresponding job offers.
It is important to consider other additional procedures and permits from the municipal and state governments, such as the operating license and the approval of civil protection.
The process of business expansion into new markets is an exciting but challenging journey.
